Terms and Conditions of Services

These terms and conditions outline the policies and practices of James Parratt ("Photographer")
regarding the provision of photography and video services in the United Kingdom. By engaging the Photographer, clients acknowledge and agree to these terms and conditions.
The hire of the Photographer under these terms and conditions does not create any affiliation or partnership between the client and the photographer.
1. General Policies
1.1 Photography services are provided in accordance with these terms. Any changes to these terms will be communicated and mutually agreed upon.
1.2 The Photographer operates independently. Third parties may not impose agency fees unless discussed and agreed upon with the Photographer in advance.
1.3 The Photographer will not be subject to non-compete clauses in any form.
2. Booking, Payment, and Cancellation
Booking and Payment
2.1 On the booking of a photoshoot, the client must pay 100% of the shoot fee within 48 hours of an invoice being delivered. The photoshoot fee includes a non-refundable 20% deposit to secure the booking.
2.2 On the booking of a photoshoot within 48 hours of the requested date, the photoshoot must be paid for in full immediately on receipt of an invoice.
2.3 Invoices not paid on time risk losing the requested photoshoot date and time, and/or their deposit.
2.4 A booking is confirmed upon agreement of the photoshoot date and time via email/WhatsApp/call or other communication.
Cancellation Policy
2.5 Cancellations made:
- 7 days or less before the scheduled session will be charged 100% of the agreed fee.
- 14 days or less before the scheduled session will be charged 75% of the agreed fee.
- 28 days or less before the scheduled session will be charged 50% of the agreed fee.
- Cancellations made 29 days or more before the scheduled session will not incur charges.
2.6 All refunds exclude the 20% deposit.
2.7 Rescheduling a shoot is down to the discretion of the photographer and may incur additional costs.
2.8 Existing bookings that have been rescheduled do not qualify for refunds.
2.9 All partial refunds or lack thereof are taken as liquidated damages to the photographer.
2.10 The photographer retains the right to cancel the photoshoot without notice for any given reason; in this event, a full refund will be provided or a rescheduled shoot at no extra cost.
2.11 In the case of an outdoor location shoot, cancellation or rescheduling on the basis of bad weather is down to the discretion of the photographer. The client understands that in booking an outdoor location shoot, the possibility of bad weather is inevitable. Only in the case of extreme weather, or to the point of it becoming extremely hazardous, will cancellation or rescheduling be a possibility. Rescheduling due to weather may incur additional charges.
2.12 The client understands that outdoor location shoots are unpredictable environments, and that agreed locations may become unavailable with very little to no notice due to, but not limited to, road closures, construction works, and areas being closed or private property.
2.13 Should a force majeure event arise, no refund shall be payable for any bookings upon which the photographer is unable to fulfil by reason of Royal demise, National Mourning, enemy action, fire, strikes, lock-outs, or by reason of the order of any licensing or other public authority having jurisdiction or for any other cause beyond the control of the photographer.
3. Copyright and Image Usage
3.1 All images and/or video produced by the Photographer remain the Photographer’s intellectual property, and the photographer retains all copyrights.
3.2 Clients are granted a license to use the images for personal and promotional use. Clients may not sell, distribute, or alter these images in any way (including additional Photoshop work, Instagram filters, or removal of the logo). Third-party and commercial (including but not limited to magazines, articles, future employers) usage are not included and must be negotiated separately with the photographer.
3.3 All images produced by the Photographer are licensed under copyright. If an image is to be used for any commercial purposes or without the appropriate credit, a buyout of the image must be made. The buyout fee will be determined based on the scope, duration, and intended commercial use of the image. Fees start at £295 and vary according to publication and presses.
3.4 The photographer asserts their right to be credited and that their name will be printed on or in reasonable proximity to all published reproductions of the media. When sharing to platforms such as but not limited to Instagram, please do at least one of the following: tag @adancerslens in the caption and/or in the image itself.
3.5 Images are intended for digital use only. For printing rights, please enquire.
4. Photographer’s Use of Images
4.1 The Photographer reserves the right to use images for portfolio purposes, promotional content, competitions, exhibitions, and commercial use. If opting out of image use, the client may be subject to an additional fee for exclusive rights, which must be discussed and agreed upon prior to the session.
5. Deliverables
5.1 The client may choose which images they want to be edited by the photographer from a gallery provided to the client. The images will be uploaded to a password-protected website, to which a link will be provided within seven days of the photoshoot ending, providing all invoices have been completed. On receipt of the selected image files, the photographer will deliver the edited images within 30 days, providing all invoices have been completed.
5.2 All images are delivered as 300ppi JPEG files and all videos are delivered as a 1080p or 4K MP4 files via Dropbox. Whilst this is deemed a secure and confidential service, the client understands their content and information (photographs/videography/e-mail address) may be shared with a third-party organisation (Dropbox).
5.3 The editing of the media is at the artistic discretion of the photographer. No editing shall occur that the photographer deems unethical. Editing requests must be made aware to the photographer prior to the completion of the booking. Additional charges may apply.
5.4 A next-day gallery of images can be provided for an additional £35.
6. Health & Safety and Damages
6.1 The client understands that photography sessions in and out of the studio are potentially hazardous and that all attending the shoot must act in a cautious and sensible manner. The photographer holds no responsibility for any possible injury incurred whilst shooting outside of reasonable duty of care. A risk assessment will be provided upon request.
6.2 The client agrees that any damages to property belonging to the photographer caused by themselves will be paid up to the replacement value of the item or items in full within 30 days of the damages occurring.
7. Limitations of Liability
7.1 The client understands that whilst the photographer will make every reasonable attempt to fulfil our requests, due to circumstances beyond the photographer’s control (weather, camera malfunction, etc.), these requests may not be met. The photographer’s liability in these instances is a re-shoot at the photographer’s discretion.
7.2 The client understands that the photographer may employ one or more assistants, second shooters, and videographers for the shoot/s. Any behind-the-scenes footage will be taken and stored either on the photographer’s or assistant’s devices.
7.3 All images and video taken by the client at the shoot/s are at the artistic discretion of the photographer.
7.4 The client understands that photographs and/ or videography (the media) will be taken by the photographer and that the media will be stored on devices belonging to the photographer, including but not limited to external hard drives, mobile devices, laptops, and cloud storage services including but not limited to Dropbox.
7.5 The client is responsible for saving the delivered media within 30 days of receiving a Dropbox link from the photographer. After 30 days, the link will become inactive. The photographer holds no responsibility in backing up the client’s media and to have to provide the client with the media again for any given reason. The client is advised to make multiple copies of the media provided. Providing clients with the deliverables past 30 days may incur additional charges to reopen past projects.
7.6 30 days after the delivery of the images, the photographer retains the right to delete original files. It is the responsibility of the client to back up all delivered images and/ or video, and the photographer is not liable for any lost data past 30 days.
7.7 On delivery of the final media, the photographer’s responsibilities are to be considered completed. Any further correspondence from the client regarding anything related to the delivered media or service must be done so within 30 days.
7.8 Any correspondence after the photoshoot should be handled by the client (the subject being photographed or filmed) and not any third parties, including but not limited to parents/ guardians, teachers, and the bill payer (the bill payer is not the client), unless the subject is under the age of 18.
8. Privacy and Data Protection
8.1 Personal data is handled in compliance with the General Data Protection Regulation (GDPR).
8.2 Client information is not shared with third parties without consent, except as required by law.
9. Miscellaneous
9.1 If any of the clauses mentioned above are rendered invalid, it does not invalidate any of the other clauses.
10. Confirmation Clause
10.1 By booking photography services with James Parratt - A Dancers Lens, clients confirm that they have read, understood, and agree to these terms and conditions in full.
